GEPAC's approval rules
This Ministry of Culture regulation sets out how a cultural project is appraised before donors commit and how GEPAC issues the declarations a donor needs. It covers the first application and every renewal.

1 - The regulation annexed to this despacho, of which it forms an integral part, is approved; it lays down the rules applicable to the issue by the Office for Cultural Strategy, Planning and Evaluation (GEPAC) of the declaration provided for in subparagraph b) of paragraph 8 of Article 65-D of Regulatory Decree No. 84/2007 of 5 November, as worded by Regulatory Decree No. 15-A/2015 of 2 September, for the purposes of the residence permit for investment activity (ARI, the Golden Visa).

This regulation lays down the rules applicable to the issue by the Office for Cultural Strategy, Planning and Evaluation, hereinafter GEPAC, of the declaration attesting the effective transfer of the capital for the purposes of the residence permit for investment activity, hereinafter ARI (the Golden Visa), in the cultural sector.

This regulation applies to the departments and bodies under the Minister of Culture, public and private bodies, and all entities involved in ARI proceedings in the cultural sector, as defined in subparagraph f) of paragraph 1 and paragraph 9 of Article 65-A of Regulatory Decree No. 84/2007 of 5 November, as worded by Regulatory Decree No. 15-A/2015 of 2 September.
What it means for you. The regulation binds everyone involved in a cultural-route file, from the Ministry of Culture's bodies to the beneficiary entity. Its cross-reference is to the 2015 wording of Art. 65.º-A; the cultural route is now item vi) of the law itself.

1 - A aplicação dos capitais em investimento ou apoio à produção artística, recuperação ou manutenção do património cultural nacional é feita através dos serviços da administração direta central e periférica, institutos públicos, entidades que integram o setor público empresarial, fundações públicas e fundações privadas com estatuto de utilidade pública, entidades intermunicipais, entidades que integram o setor empresarial local, entidades associativas municipais e associações públicas culturais que prossigam atribuições na área da produção artística e da recuperação ou manutenção do património cultural nacional.
2 - A natureza jurídica e ou objeto social das entidades são confirmados através dos respetivos estatutos, leis orgânicas, classificação da atividade económica, e outros documentos legais.

1 - The capital is applied to investment in or support for artistic production or the recovery or maintenance of the national cultural heritage through the departments of the central and peripheral direct administration, public institutes, entities forming part of the public business sector, public foundations and private foundations with public-utility status, inter-municipal entities, entities forming part of the local business sector, municipal associative entities and public cultural associations pursuing responsibilities in the field of artistic production and the recovery or maintenance of the national cultural heritage.
2 - The legal nature and/or corporate purpose of the entities are confirmed through their respective articles of association, organic laws, classification of economic activity and other legal documents.
What it means for you. Only listed entities can receive a cultural-route donation: private foundations with public-utility status, and public and municipal bodies. Their status is checked against their statutes and legal documents.

Procedure and appraisal
Initiation of the procedure

O procedimento pode ser desencadeado por qualquer cidadão estrangeiro individualmente ou através de sociedade unipessoal por quotas com sede em Portugal ou num Estado da União Europeia, com estabelecimento estável em Portugal.

The procedure may be initiated by any foreign citizen individually or through a single-member private limited company (sociedade unipessoal por quotas) with its registered office in Portugal or in a Member State of the European Union, with a permanent establishment in Portugal.
What it means for you. You can apply personally, or through a single-member company with its registered office in Portugal, or in another EU state with a permanent establishment in Portugal.

Submission of the request

São os seguintes os trâmites processuais a que devem obedecer os pedidos:
a) Sem prejuízo do previsto no artigo 8.º, o procedimento inicia-se com a apresentação junto do GEPAC do pedido de apreciação prévia do projeto ou ação em causa;
b) O pedido pode ser efetuado pelos responsáveis das atividades que queiram procurar investimento ou apoio, ou pelo próprio investidor, ou representante legal;
c) O GEPAC reencaminha o pedido para o serviço ou organismo na dependência ou sob tutela do Ministro da Cultura competente na área a que se destina o investimento, que deve proceder à sua apreciação prévia;
d) A apreciação prévia referida na alínea anterior deve ser feita no prazo máximo de 10 dias úteis, contados a partir do dia seguinte à entrada do pedido no serviço ou organismo, findos os quais é remetida ao GEPAC;
e) Após o investimento ou apoio, o investidor, ou o seu representante legal, solicita ao GEPAC a declaração comprovativa da transferência bancária para a entidade e a atividade que foi alvo de apreciação do organismo competente;
f) O GEPAC, caso verifique que toda a documentação exigida está em conformidade, emite a declaração a que se refere a alínea anterior.

The requests must follow these procedural steps:
a) Without prejudice to Article 8, the procedure begins with the submission to GEPAC of the request for prior appraisal of the project or action concerned;
b) The request may be made by those responsible for the activities seeking investment or support, or by the investor, or a legal representative;
c) GEPAC forwards the request to the department or body under or supervised by the Minister of Culture that is competent in the area for which the investment is intended, which must carry out its prior appraisal;
d) The prior appraisal referred to in the preceding subparagraph must be carried out within a maximum of 10 working days, counted from the day after the request is received by the department or body, after which it is sent to GEPAC;
e) After the investment or support, the investor, or their legal representative, requests from GEPAC the declaration proving the bank transfer to the entity and activity that was appraised by the competent body;
f) GEPAC, if it finds that all the required documentation is in order, issues the declaration referred to in the preceding subparagraph.
What it means for you. The project is appraised first, at the request of those responsible for it or of the investor, by the Ministry of Culture body competent for the area, within 10 working days. After the transfer, the investor asks GEPAC for the declaration that the money reached the appraised entity and activity.

Prior appraisal by the departments and bodies

Os serviços e organismos referidos na alínea c) do artigo anterior devem pronunciar-se sobre:
a) A confirmação da natureza jurídica da entidade responsável pela atividade cultural;
b) A confirmação do objeto social da entidade responsável pela atividade cultural;
c) A adequação do montante a investir ou a apoiar à zona territorial a que diz respeito a atividade;
d) A adequação do montante a investir ou a apoiar à atividade proposta;
e) Os objetivos pretendidos pela atividade alvo de investimento ou apoio.

The departments and bodies referred to in subparagraph c) of the preceding Article must give their opinion on:
a) Confirmation of the legal nature of the entity responsible for the cultural activity;
b) Confirmation of the corporate purpose of the entity responsible for the cultural activity;
c) The suitability of the amount to be invested or given in support for the territorial area to which the activity relates;
d) The suitability of the amount to be invested or given in support for the proposed activity;
e) The objectives pursued by the activity receiving the investment or support.
What it means for you. The Ministry of Culture checks the beneficiary entity, the amount and the project's objectives before the project is open to donors.

Regime applicable to the departments and bodies under or supervised by the Minister of Culture
Regime aplicável aos serviços e organismos na dependência ou tutela do Ministro da CulturaPortuguês
1 - Os serviços e organismos na dependência ou sob tutela do Ministro da Cultura que forem alvo de investimento ou apoio ficam excecionados da apreciação prévia de outras entidades sob a mesma tutela se:
a) Os planos de atividades aprovados integrarem a atividade a financiar ou apoiar; ou
b) Forem definidas ações a financiar ou a apoiar expressamente aprovadas pela tutela para efeitos de ARI.
2 - Com as devidas adaptações, o processo tem início com a entrega dos documentos obrigatórios constantes no n.º 1 artigo 9.º
3 - Deve ainda ser entregue uma breve memória descritiva do investimento ou ação a financiar ou a apoiar na qual conste o referido nas alíneas c) a e) do artigo 7.º

1 - Departments and bodies under or supervised by the Minister of Culture that receive investment or support are exempt from prior appraisal by other entities under the same supervision if:
a) Their approved activity plans include the activity to be financed or supported; or
b) Actions to be financed or supported are defined and expressly approved by the supervising Minister for ARI purposes.
2 - With the necessary adaptations, the process begins with the submission of the mandatory documents listed in paragraph 1 of Article 9.
3 - A brief descriptive report of the investment or action to be financed or supported must also be submitted, setting out the matters referred to in subparagraphs c) to e) of Article 7.
What it means for you. Where the beneficiary is itself a Ministry of Culture body, an approved activity plan or a ministerial approval replaces the separate appraisal.

Mandatory documents

1 - Devem fazer parte integrante e obrigatória do processo os seguintes documentos:
a) Confirmação da atividade para efeito de investimento;
b) Documento legal a que se refere o n.º 2 do artigo 3.º do presente regulamento comprovativo da natureza jurídica e ou do objeto social da entidade que pretende receber o investimento ou apoio;
c) Documento que descreva a atividade de produção artística ou de recuperação ou manutenção do património cultural em que se pretende investir;
d) Identificação do requerente e exposição dos motivos do pedido;
e) Pedido feito pelo requerente ou representante legal e dirigido ao GEPAC solicitando a declaração comprovativa da transferência efetiva do capital;
f) Identificação do requerente de ARI e ou do representante legal do requerente de ARI com poderes especiais para apresentar o pedido, se for o caso;
g) Procuração no caso do requerente de ARI estar a ser representado;
h) Declaração de instituição de crédito autorizada ou registada em território nacional junto do Banco de Portugal, atestando a transferência efetiva de capitais nos montantes legalmente previstos para conta bancária do titular responsável pela atividade alvo de investimento ou apoio;
i) Declaração sob compromisso de honra, na qual a entidade beneficiária do investimento ou apoio se compromete a utilizar o capital exclusivamente na atividade selecionada pelo investidor, objeto de apreciação prévia nos termos do artigo 7.º, e que cumpre todos os requisitos legalmente exigidos, bem como os constantes do presente regulamento.
2 - Sem a apreciação prévia não é emitida a declaração a que se refere a alínea b) do n.º 8 do artigo 65.º-D do Decreto Regulamentar n.º 15-A/2015, de 2 de setembro.

1 - The following documents must form an integral and mandatory part of the file:
a) Confirmation of the activity for investment purposes;
b) The legal document referred to in paragraph 2 of Article 3 of this regulation proving the legal nature and/or corporate purpose of the entity intending to receive the investment or support;
c) A document describing the artistic production activity, or the activity of recovery or maintenance of the cultural heritage, in which the investment is intended;
d) Identification of the applicant and a statement of the reasons for the request;
e) A request made by the applicant or legal representative and addressed to GEPAC asking for the declaration proving the effective transfer of the capital;
f) Identification of the ARI applicant and/or of the ARI applicant's legal representative with special powers to submit the request, where applicable;
g) A power of attorney where the ARI applicant is represented;
h) A declaration from a credit institution authorised or registered in national territory with the Banco de Portugal, attesting the effective transfer of capital in the legally provided amounts to the bank account of the holder responsible for the activity receiving the investment or support;
i) A declaration on honour in which the beneficiary entity of the investment or support undertakes to use the capital exclusively in the activity selected by the investor, which was the subject of prior appraisal under Article 7, and declares that it meets all the legally required conditions as well as those of this regulation.
2 - Without the prior appraisal, the declaration referred to in subparagraph b) of paragraph 8 of Article 65-D of Regulatory Decree No. 15-A/2015 of 2 September is not issued.
What it means for you. The file includes the bank's declaration that the money reached the account of the entity responsible for the activity, and the beneficiary's declaration on honour that it will use it only on the appraised activity. Without the prior appraisal, GEPAC issues no declaration.

Investment and after
Transfer of the investment

Confirmada a atividade a financiar ou a apoiar por parte do GEPAC, o investidor pode efetuar o investimento ou apoio, através da sua transferência para a entidade responsável pela atividade.

Once GEPAC has confirmed the activity to be financed or supported, the investor may make the investment or support by transferring it to the entity responsible for the activity.
What it means for you. The activity is confirmed before you transfer: you donate only to an activity already appraised by the Ministry of Culture and confirmed by GEPAC, and the money goes to the entity responsible for it.

Completion of the investment
Conclusão do investimentoPortuguês
No prazo de dez dias úteis a contar da conclusão do investimento ou ação financiada ou apoiada, deve o investidor informar o GEPAC, em declaração sob compromisso de honra, da sua conclusão.

Within ten working days of the completion of the investment or the action financed or supported, the investor must inform GEPAC of its completion in a declaration on honour.
What it means for you. When the funded project is completed, GEPAC is told within ten working days by a declaration on honour.

Map of initiatives for investment
Mapa de iniciativas para investimentoPortuguês
1 - As entidades beneficiárias devem manter organizado e acessível, designadamente através de meios electrónicos, um mapa atualizado das iniciativas passíveis de serem apoiadas no âmbito do presente regulamento, para consulta dos potenciais interessados.
2 - Do mapa referido no número anterior deve ser dado conhecimento ao GEPAC, sempre que objeto de atualização.
3 - O GEPAC procederá à divulgação da lista das iniciativas passíveis de serem apoiadas na sua página eletrónica, em conformidade com a informação atualizada e facultada pelas entidades beneficiárias.

1 - Beneficiary entities must keep organised and accessible, namely by electronic means, an up-to-date map of the initiatives eligible for support under this regulation, for consultation by potential interested parties.
2 - GEPAC must be informed of the map referred to in the preceding paragraph whenever it is updated.
3 - GEPAC shall publish the list of initiatives eligible for support on its website, in accordance with the up-to-date information provided by the beneficiary entities.

Renewal
Renewal of the residence permit
Renovação da autorização de residênciaPortuguês
1 - Para efeitos de renovação de autorização de residência, o requerente, ou o seu representante legal, deverá solicitar declaração ao GEPAC, atestando que não se verificaram alterações supervenientes imputáveis ao requerente que tenham comprometido o investimento ou apoio realizado ou conseguido.
2 - O requerente, ou o seu representante legal, deverá anexar a este pedido os documentos comprovativos da realização da atividade alvo de investimento ou apoio e do cumprimento dos objetivos propostos, designadamente relatório de atividade e de execução financeira, facultados pelo responsável da atividade com a demonstração dos impactos esperados no período de cinco anos.
3 - O GEPAC deve solicitar aos serviços e organismos na dependência ou sob tutela do Ministro da Cultura que apreciaram previamente a atividade alvo de investimento ou apoio o respetivo parecer, dando conta da realização do investimento ou apoio na atividade escolhida e da concretização dos objetivos e dos impactos propostos no período temporal em causa.

1 - For the purposes of renewal of the residence permit, the applicant, or their legal representative, must request a declaration from GEPAC attesting that no supervening changes attributable to the applicant have occurred that have compromised the investment or support made or obtained.
2 - The applicant, or their legal representative, must attach to this request the documents proving that the activity receiving the investment or support has been carried out and that the proposed objectives have been met, namely an activity and financial execution report, provided by the person responsible for the activity, demonstrating the impacts expected over the five-year period.
3 - GEPAC must request an opinion from the departments and bodies under or supervised by the Minister of Culture that carried out the prior appraisal of the activity receiving the investment or support, reporting on the application of the investment or support to the chosen activity and on the achievement of the proposed objectives and impacts over the period concerned.
What it means for you. At each renewal GEPAC confirms that no change attributable to you has compromised the support. The project's activity and financial reports, supplied by the beneficiary, back the request.

Cooperation

Os serviços e organismos na dependência ou sob tutela do Ministro da Cultura que intervenham no processo de atribuição de ARI podem solicitar o apoio da Inspeção-Geral das Atividades Culturais sempre que seja necessário confirmar a verificação dos requisitos previstos neste regulamento.

The departments and bodies under or supervised by the Minister of Culture involved in the ARI granting process may request the support of the Inspectorate-General for Cultural Activities (IGAC) whenever it is necessary to confirm that the requirements of this regulation are met.
What it means for you. The Ministry of Culture's inspectorate can be called in to verify that the requirements are met.
